CHANEL vs. Notino: A Decision That Changes the Game for Trademark Owners
CHANEL succeeded in its dispute against Notino after the High Court in Prague granted the company the right to obtain information regarding the origin of goods sold outside the authorized distribution system.
The decision represents an important development in the field of trademark protection and selective distribution. The Court confirmed that, in order to obtain such information, it is sufficient to demonstrate a likelihood of infringement, while the information obtained may subsequently serve as key evidence in further proceedings.
The ruling also strengthens the legal tools available to brand owners in protecting distribution systems and monitoring the origin of products placed on the market.
