Consent to the processing of personal data

By completing the contact form, you hereby give your consent in accordance with Articles 4(11), 6(1)(a) and 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 20162016 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) in the consolidated version (hereinafter referred to as the “Regulation“), the provisions of § 5(a), § 13(1)(a) and § 14 of Act No. 18/2018 Coll. on the protection of personal data and on amendments to certain acts, as amended (hereinafter referred to as the “Act“), the provisions of Section 116(3) and (5) of Act No. 452/2021 Coll. on Electronic Communications, as amended, and the provisions of Section 3(3) of Act No. 147/2001 Coll. on Advertising and on Amendments to Certain Acts, as amended,

as the data subject within the meaning of Article 4(1) of the Regulation and the provisions of Section 5(n) of the Act, who has reached the age of 16 (in words: sixteen) (hereinafter referred to as the “Data Subject“), I hereby consent to the processing of personal data by Advokátska kancelária LEGATE s. r. o., with its registered office at Dvořákovo nábrežie 8A, 811 02 Bratislava – Staré Mesto district, Slovak Republic, ID No.: 35 846 909, registered in the Commercial Register of the Municipal Court of Bratislava III, Section: Sro, file no.: 27692/B (hereinafter referred to as the “Controller“), as the controller within the meaning of Article 4(7) of the Regulation and the provisions of Section 5(o) of the Act,

for the purpose of inclusion among the Operator’s potential clients and for future contact, including the sending of information, service offers, advertisements and other marketing communications, for a period of three years from the granting of this consent or until its revocation, whichever occurs first. This consent applies to the processing of the following personal data: email address.

The data subject declares that the personal data provided by them is complete, true, accurate and up to date, and that they will notify the Controller of any changes without delay.

The data subject further declares that, prior to giving their consent, they have been informed of the following facts:

(i) the provision of personal data by the data subject, as well as the granting of their consent, is voluntary;

(ii) the legal basis for the processing of the Data Subject’s personal data by the Controller is consent within the meaning of Article 6(1)(a) of the Regulation and the provisions of Section 13(1)(a) of the Act;

(iii) consent may be withdrawn at any time (i.e. even before the expiry of the period for which it was given) free of charge by sending a withdrawal of consent by email to info@legate.sk or by sending a written request to the above address of the Controller’s registered office, provided that the withdrawal of consent does not affect the lawfulness of the processing of personal data based on consent before its withdrawal;

(iv) personal data will be processed only for the time necessary to fulfill the purpose of their processing, but no longer than the above-mentioned period of consent, unless the personal data obtained are necessary for the exercise of a relevant legal claim in accordance with the above-mentioned purpose of personal data processing. Such personal data shall be stored separately to the extent necessary and may be provided to law enforcement authorities or other authorities to which the Controller is required by law to provide such records and/or before which the Controller asserts its claims arising from the contract and/or the law;

(v) due to technical complexity, the personal data of the Data Subject may be provided by the Controller to other recipients of personal data, such as an advertising agency, a newsletter platform, or an information technology service provider;

(vi) the processing of personal data does not include individual decision-making based solely on automated processing with legal effects, including profiling;

(vii) no cross-border transfer of personal data to a third country or international organization takes place;

(viii) The data subject may exercise several rights against the Controller, in particular the right to request access to personal data or their erasure, to lodge a complaint with the supervisory authority – the Office for Personal Data Protection of the Slovak Republic;

(ix) further information on the processing of personal data by the Controller is available at the Controller’s registered office, on the website www.legate.sk in the Privacy Policy section, at the email address info@legate.sk or by telephone at + 421 262 527 561;

(x) The Controller reserves the right to restrict, postpone, change, suspend or terminate the sending of marketing and advertising communications at any time.

Finally, the Data Subject confirms that the Controller provided them with detailed information about the collection and processing of their personal data and about their rights in this regard in accordance with Articles 13 and 14 of the Regulation and the provisions of § 19 and § 20 of the Act, including other information necessary for the granting of consent.
